All references to "the Company", "we", "us" and "our" in these terms and conditions are deemed to refer to Modular Building Components (PTY) Ltd T/A Modular Cupboards

All references to "you" and "your" are deemed to refer to any user and/or visitor of www.modcupboards.co.za ("Website").
These terms and conditions ("Terms and Conditions") govern
1) your use of the website; and
2) your use of the forum.
1. Acceptance of terms
The Company permits the use of this Website subject to the Terms and Conditions ("Terms and Conditions").
By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.
2. Use of the Website
1. You may only use the Website if you are 18 years of age or older. If you are under 18, you may use the Website only with the supervision of your parent or legal guardian.
2. You agree that you will not use any device, software or other instrument to interfere or attempt to interfere with the proper working of this Website ("Website"). In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the Website or the information contained herein, without the prior written consent from an authorised Company representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this Website).
3. You may not use the Website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.

6. Unless stipulated the shown prices exclude accessories used for display purposes and include 14% VAT.
We reserve the right to limit quantities sold to individual customers. At the time of publication all prices on display are correct. Should the incorrect details or price be printed the correct information will be available in-store. Modular Building Components (PTY) Ltd T/A Modular Cupboards. reserves the right to change, amend or discontinue any product, product description or price without prior notice.
4. Linked third party websites
1. This Website may contain links or references to other websites ("Third Party Websites") outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third Party Websites and the Company accepts no responsibility for the practices and/or privacy policies of those Third Party Websites
or the “cookies” that those sites may use.
2. Notwithstanding the fact that this website may refer to or provide links to third party websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon.
5. Monitoring
We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

If you disclose your personal information to a third party, such as an entity which operates a website linked to this Website or anyone other than the Company, THE COMPANY SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, HOWSOEVER ARISING, SUFFERED BY YOU AS A RESULT OF THE DISCLOSURE OF SUCH INFORMATION TO THE THIRD PARTY. 7. Limitation of liability

THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL INJURY, LOSS OR DAMAGES WHICH MIGHT ARISE FROM YOUR USE OF, OR RELIANCE UPON, ANY MATERIAL OR CONTENT CONTAINED IN, OR INABILITY TO USE, AND/OR UNLAWFUL ACTIVITY ON, THE WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.
2. YOU HEREBY INDEMNIFY THE COMPANY AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR ANY THIRD PARTY ARISING IN ANY WAY FROM YOUR USE OF THIS WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.
8. Updating of these Terms and Conditions
We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered
notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
1. Availability and termination
1. We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and reserve the right to discontinue providing the Website or any part thereof with or without prior notice to you.
2. The Company may in its sole discretion terminate, suspend and modify this Website, with or without prior notice. You agree that the Company will not be liable to you in the event that it chooses to suspend, modify or terminate this Website.
2. Governing Law These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions. The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and
pursue proceedings in alternative jurisdictions.
9. TERMS AND CONDITIONS OF SALE
1. Sale of Goods
1. These Terms and Conditions of Sale govern the sale of products ("Goods") by the Company to you via the Website. The Terms and Conditions of Sale are in addition to the terms and conditions of use of the Website, which can be viewed at www.modcupboards.co.za under information.
2. Once you tick the box labelled "I accept", these Terms and Conditions of Sale form a legally-binding agreement between you and the Company. You may contact us via email at Customer Care to obtain a full record of your transaction. We will in any event confirm all your purchase orders with you via email.
2. Product Availability Should the product not be in stock please allow 5 (five) working days plus freight transit time. This will allow for manufacturing and delivery to our factory. Every effort is made to have your order ready for collection or delivery however unforeseen circumstances may cause delays. Should we be faced with such an occurrence Modular Building Components (PTY) Ltd T/A Modular Cupboards will contact you via email and provide a revised collection or delivery date.
3. Delivery Policy When you click to make a purchase with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase. If you have any queries please contact us before making any purchase for any service through this website.
4. Prices/Pricing
1. All transactions will be processed in South African Rands (ZAR)
2. Prices/Pricing on the website (“www.modcupboards.co.za”) is only valid for stores listed under Store details.
5. Payment
1. Payment can be made via the Website by –
1. Credit Card (We accept MasterCard and Visa credit cards. If you do not have a credit card please utilise one of the other payment options, or simply log off and return to the site at a later time to complete your order. All of your order details will be saved online under in the Your Account section available for use whenever you’re ready).
2. IPAY, which is an instant Electronic funds transfer, instant or automated EFT is a streamlined version of a traditional EFT. It makes payment of a bank transfer a lot faster and easier by eliminating certain steps such as reference number and amount entry. The payment method only requests from buyers, those values which are not known to them such as account number and one time pins.
1. How does IPAY work?
1. Select i-Pay as your payment option during checkout
2. Select your bank from the list presented
3. Login to the i-Pay portal using your internet banking credentials
4. Select an account to pay from (If you only have one account, it will be automatically selected for you and this step will be skipped)
5. The automated process will navigate and populate the relevant fields on your behalf in the background
6. Your bank will send you a form of payment authentication either by means of SMS, USSD Push message or In-App
7. Once you have successfully authorised your payment, the transaction is marked as complete
8. I-Pay sends notification to the seller on the outcome of the transaction and inturn, the seller will process your order immediately. There is no need to send through a proof of payment and no need to wait for the funds to reflect in the seller’s bank account.
3. Cash/ Credit Card or Debit payment can be made at the store when collecting
Delivery/Collection
1. We currently DO deliver on special request with an additional delivery charge,
1. Product (“Goods”) may only be order online and collected at our factory.
2. You may contact our factory should you want to send your own courier service to pick up, once EFT payment has been approved and cleared.
7. Security Policy
1. Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site’s registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.
2. Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet
servers are protected by firewalls and intrusion detection systems.
3. The Merchant does not have access to credit details.
4. Virtual Card Services continually reviews and enhances its security in line with technological changes.
8. 3D Secure for online shopper’s
South African banks and e-commerce merchants are implementing 3D Secure to help protect
you, the cardholder, against unauthorised use of your card when shopping online at 3D Secure
merchants. 3D Secure allows you to authenticate yourself while making an online payment,
therefore minimising the risk of someone else using your card fraudulently.
What is 3D Secure?
• It is also called Verified by Visa, MasterCard SecureCode or Amex Safekey
• It is an authentication service that allows only the cardholder to use the card
• It allows you to enter your previously selected PIN/Password or a One Time PIN therefore helping your bank to know it is you shopping online
• With additional focus on the safety of e-commerce transactions,
o your bank may have already registered you for the service, or
o you may be required to register during your next online purchase.
What can you expect when doing an online 3D Secure purchase?
If you have already registered or have been registered by your bank, you will be prompted with an additional screen requesting a One Time PIN (OTP) or a PIN/Password. OTPs are sent to the cell phone number your bank has on record for you, whilst a PIN or Password is a secret code you have chosen when you registered for 3D Secure or was provided to you by your bank at the time of issuing your card. Simply enter the OTP, PIN or Password in the given space and proceed.If it is your first time doing an e-commerce transaction, or you are a regular e-commerce user, but have never registered or been registered for the 3D Secure service, you will be prompted with a screen asking you to register for 3D Secure. Please follow the prompts on the screen to register. Remember, it is in your best interest to be safe.
Tips for a good 3D Secure experience
• Ensure you have the card you wish to pay with ready.
• Ensure you have your cell phone with you to receive the One Time PIN (OTP) or you know what your PIN or Password is, depending on what your bank’s authentication method is.
• After entering your PIN/Password, the system may take a couple of seconds to authenticate your PIN/Password. This is normal – do not close the browser.
• If you receive an error message, be sure to read the message on the screen. You may have entered your PIN/Password incorrectly in which case you will be allowed to retry. Although minimal, there may also be other reasons why the transaction failed, in which case we recommend that you follow the instructions on the screen or contact your bank for further assistance. 3D Secure is easy to use and will give you peace of mind to shop online. Be safe, be smart!
9. PRIVACY
We take the security of your personal information seriously. All personal information that you provide to us is subject to our Privacy Policy. However, due to the nature of the Internet, we cannot guarantee that your communications will be free from unauthorised access by third parties. Accordingly, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGES ARISING FROM THIRD PARTIES'' UNAUTHORISED ACCESS OF YOUR DATA.
10. CANCELLATION AND REFUND
1. You are entitled to cancel your order for the Goods, without penalty, within 24 hours of the Goods being ordered. .
11. Returns Policy
1. Unfortunately we do not have a return policy as the cupboards we manufactured although it is D.I.Y cupboards are specifically manufactured to the customers requirements. The following items will not be accepted for return:- Cut to size items that have been made to suit your needs- Specially ordered items - Miss used & or purposely damaged items.
12. Breach
1. If any party ("Defaulting Party") breaches any of these terms and conditions and fails to remedy such breach within 14 (fourteen) days of receipt of notice to remedy the breach, the aggrieved party shall be entitled to claim specific performance or to cancel this agreement forthwith upon written notice to the defaulting party, without prejudice to its right to recover:
1. any amounts that may be due to it in terms of this agreement; and
2. any loss or damage suffered as a consequence of the breach or the cancellation of this agreement.
13. Governing law and jurisdiction
1. Our relationship and/or any dispute arising from or in connection with these terms and conditions of sale shall be governed by the laws of the Republic of South Africa. You agree to be subjected to the exclusive jurisdiction of the South African courts.
14. NOTICES
1. The Company hereby selects No 4 Neiwerheids Crescent, Bronkhorstspruit, 1020 as its address for the service of all formal notices and legal processes in
connection with these terms and conditions of sale ("domicilium"). You hereby select the
address specified on the Goods order form as your domicilium. Either party may change its
domicilium to any other physical address by not less than 7 days'' notice in writing to the other party.
Notices must be sent either by hand, prepaid registered post, telefax or email and must be in English. All notices sent – 1. By hand will be deemed to have been received on the date of delivery;
2. By prepaid registered post, will be deemed to have been received 10 days after the date of posting;
3. By telefax before 16h30 on a business day will be deemed to have been received, on the date of successful transmission of the telefax. All telefaxes sent after 16h30 or on a day which is not a business day will be deemed to have been received on the following business day; and
4. By email will be deemed to have been on the date indicated in the "Read Receipt" notification. ALL EMAIL COMMUNICATIONS BETWEEN YOU AND US MUST MAKE USE OF THE "READ RECEIPT" FUNCTION to serve as proof that an email has been received.
15. Consent
1. I understand that all the designs and trademarks are registered to Modular Building Components (PTY) Ltd T/A Modular Cupboards and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Modular Building Components (PTY) Ltd T/A Modular Cupboards for any civil action or any legal action deemed necessary against me.
16. General
1. You may not cede, assign or otherwise transfer your rights and obligations in terms of these terms and conditions of sale to any third party.
2. Any failure on the part of you or the Company to enforce any right in terms hereof shall not constitute a waiver of that right.
3. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
4. No variation, addition, deletion, or agreed cancellation of these terms and conditions will be of any force or effect unless in writing and accepted by or on behalf of all the parties hereto.
5. No indulgence, extension of time, relaxation or latitude which any party ("the grantor") may show grant or allow to the other ("the grantee") shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its legal rights against the grantee which may have arisen in the past or which might arise in the future.
6. These terms and conditions of sale, read together with the Terms and Conditions of Use of the Website, the Terms and Conditions of Use of the Forum, and our Privacy Policy contain the whole agreement between you and the Company and no other warranty or undertaking is valid, unless contained in this document between all the parties.', 'Terms & Conditions', 'Terms & Conditions', 'Terms & Conditions');
How to Order
Our factory pick up feature allows you to order online 24 hours a day and pick up at our Bronkhorstspruit.
Factory pick up is fast, easy, and free.
Here is how to select factory pick up. Simply add the desired items to your shopping cart. Once you completed shopping click View cart/Checkout. Select View cart/Checkout if you do not have a registered account.
It is compulsory to create an account, you will be asked for your billing information.
The benefits of creating an account:
a. Your billing information will be safely stored to make future orders fast and simple!
b. You will be the only one with the access to your account!
c. A history of orders will be created for your review at any time!
d. It’s free!
Once you have completed your shopping and are ready to order, you will be given shipping options and a factory pick up option in your cart. Select factory pick up and click on View cart/Checkout. Then click continue .Choose your preferred payment method. Check the Terms and Conditions box, then click on continue. Review your order and click on the "Confirm Order" button. Print out your order summary for your personal records. An order acknowledgement e-mail will be sent to you immediately after submitting your order. Once your order is ready, a second e-mail will be sent to you confirming your products are ready for collection. Print a copy of the confirmation e-mail or show a copy of your order on your mobile phone when you are at the factory. PLEASE NOTE: You will need a copy of your confirmation e-mail or order number.
Standard Cupboard Terms & Conditions :
* Please note that this quotation is valid for 7 days and prices may change due to price increases and availability from our suppliers.
* That the layout and design was done in accordance with the customers requirements.
* The client is required to initial final floor plan which will confirm approval and sign off.
* All measurements is the customers responsibility as we design and manufacture according to the customers specification and measurements.
* If the customer fails to sign off the final floor plan, designs and quotation it will be accepted that the customer is satisfied with the design and quotation once a deposit is received in the bank account as indicated below.
* Modular Cupboards can not accept changes from what have been quoted once quotations are accepted. Should anything additional be required afterwards another quotation will be issued, the additional quotation will constitute a separate contract and payment of the variation must be paid in full prior to commencement of manufacturing thereof.
* Although care will be taken to ensure differences are minimal natural materials i.e. wood, granite and paint may differ slightly from samples.
* Modular Cupboards will not be held liable for costs incurred due to delays by third party contractors (tilers, plumbers, painters, electricians or cupboard installers)
* The delivery date can only be finalized on receipt of 80% deposit, this is due to fluctuation in
supplier lead times. Delivery commences 14-18 business days after payment is received excluding Saturdays & Sundays.
To ensure the highest of quality of cupboards have been manufactured and sufficient time have been granted for manufacturing..
* The customer and the client both agree that the official means of communication will be by e-mail or WhatsApp between Modular Cupboards and themselves.
* Modular Cupboards can be reached at info@modcupboards.co.za or through the WhatsApp group created for the manufacturing of the cupboards.
* Please note that all cupboards to be delivered is DIY Pre Assembled Cupboards. The Handles, Legs and other hardware except from what were quoted is the customers responsibility to supply and purchase. Please note that we are in no way responsible for installation of the cupboards and that the above is strictly D.I.Y
* A list of carpenter subcontractors for assisting with the D.I.Y installation is available from our offices.
* The balance payment of 20% is payable one day prior to delivery (24 hours prior to delivery). The customer is more than welcome to visit our premises 1 day before delivery to inspect the quality and to view the cupboards that have been manufactured. Our factory address is No 4 Neiwerheids Crescent, Ovipro Park, Industria, Bronkhorstspruit. Please book an appointment 1 day in advance prior to viewing the cupboards.
* Please note that all cupboards are to be wrapped in plastic prior to delivery to ensure that no damages occur to the cupboards.
* Customers can also request photo's of the finalized products prior to delivery that will be sent to the customer via the WhatsApp group created for the cupboards to be manufactured.
* Only Standard Hinges, Std Ball Bearing Drawer Runners To Be Supplied. Customer to supply cupboard legs, fasteners, handles, Cupboard Rails, Aluminum Kickplates, cleaning material etc.… A full list of hardware required for project will be prepared and sent with the quotation. Please note that Glazing (The supply of glass shelves or glass for glass doors), Electrical & Plumbing is not included in our quotation. Please note Glass and Glazing is excluded from our supply of cupboards.
* NB!! Please note tall cupboard shelving pins are not pre-drilled unless specially requested by the customer. As some customers don’t prefer shelving pin holes throughout their cupboards side panels. Shelving pin holes can easily be done on site with a 4.8mm drill bit. The carpenter on site will do the drilling for shelving. Also please note that assembly of tall units requires an intermediate skill of a carpenter and a toolset that comprises of Small Compressor, Nail Gun, Skill Saw etc... If a customer requires knock down fittings for assembly it must be specifically requested. Although installation is much easier using knock down fittings it will have an influence on the durability and strength of the cupboards. The suggested assembly method would be using Screws and Nail Gun Brad Nails for optimal strength and durability.
